USA Online Casinos

Online casinos in the USA are a bit of a messy market in my opinion where each state has its own laws and regulations and where each state also has different online casinos that are accepted. On this page, I’m not going to guide you to the best casinos, but rather explain how the regulation works and which sites you can visit to learn more and find the best gaming sites with a certain license.

Let’s start by looking at how you who live in one of the following states can find licensed casinos for you.

The rest of the USA

For the states in the USA where online gambling has not been explicitly legalized, regulated, or banned at the state level, federal laws primarily govern online gambling activities. Here is an overview of the key federal laws that apply to online gambling across the rest of the USA:

Unlawful Internet Gambling Enforcement Act (UIGEA) of 2006:

  • Role: The UIGEA prohibits the processing of payments related to illegal online gambling. It targets financial institutions and payment processors, making it illegal for them to knowingly accept payments in connection with unlawful online gambling.
  • Impact: The UIGEA does not make online gambling itself illegal but complicates financial transactions for online gambling activities that are not legalized by state law.
  • Application: Affects all states by restricting payment processors but allows states to regulate online gambling within their borders if they choose to do so.

Off-shore casinos in USA

Off-shore casinos are considered illegal in the states that have their own license, because they lack their license. In the rest of the US, off-shore casinos are legal because there is no state regulation.

Who can play at Off-shore casinos?

Actually everyone! It is absolutely not illegal for you to play at an off-shore casino even if you live in a state that has its own regulation. What is illegal is for the casino to market its casino to a target group in the state where there is regulation. However, the local authority and license cannot protect you when you play at off-shore casinos. The states in the USA that do not have their own regulation are considered to be states where it is completely legal to play at off-shore casinos.

ZED`s opinion on the US gambling market

Well, I would have liked all states to have one license issuer, the same rules and the same operators for the entire country. It would have been easier for all players and easier for the US to regulate the market. At the same time, it would have meant that some states that, for example, do not want to offer online casinos must do so. Although it sounds boring, it is outweighed by the fact that the whole country had a regulated market, which I think would have been better.
